What data IS NOT collected: Personal and Sensitive User Data

AWC applications do not collect the following kinds of information:

• Personal identifiable information
• Financial and Payment information
• Device Location
• Authentication information
• Phone book
• Contacts
• SMS
• Call related data
• Health data
• Inventory of apps on the device
• Microphone
• Camera
• Other sensitive device or usage data

What data is collected

To improve the quality of our apps, AWC applications use 3rd party libraries to collect the types of data listed below:

• Application’s version number
• Unique device identifier (Apple: Advertising ID, Android: App Set ID, or a unique ID generated upon application installation)
• Crash information :
  • A trace of program methods showing where the crash occurred
  • The type of crash

This information is collected for the following purposes:

• Analytics :
  • How many unique installations of an app is used over a time period.
  • How many app starts and stops occur over a time period.
• Crash Logs :
  • What parts of the application program were running when the app crashed.
  • What portion of the app users have experienced this issue

Who is this data shared with

The above data is shared with a 3rd party crash reporting and analytics services.  At the time of publication, these services are:

• Google Play (https://play.google.com/intl/en-US_us/about/play-terms/index.html) : All apps published in Google Play do this.
• Apple App Store (https://www.apple.com/legal/privacy/data/en/app-store/) : All apps published in the Apple App Store do this.

CFS Checklist App Terms of Use

1. LICENSE GRANT. This TOU provides to an individual user (identified herein as “you” or “user” or with “your”) a personal, revocable, limited, non-exclusive, nontransferable, and non-sublicensable license to use the App on a single mobile or computer device that is owned or otherwise controlled by you.
2. LICENSE GRANT RESTRICTIONS. This TOU provides only a license and not an assignment nor sale. AWC transfers no ownership or intellectual property interest or title in and to the App, to you, or anyone else. Further, AWC reserves all rights not expressly granted by this TOU. Accordingly, you may not modify, translate, decompile, reverse engineer, create derivative work(s) of, copy, distribute, disassemble, broadcast, film, transmit, display, publish, remove, or alter any proprietary notices or labels, license, sublicense, permit use by any (other) person or entity, transfer, sell, mirror, frame, exploit, rent, lease, private label, grant a security interest in, or otherwise use in any manner not expressly permitted herein (or by AWC) the App. In addition, you shall not enter any contractual relationship or other legally binding obligation with any third party or person which shall have the purpose or effect of encumbering AWC or the use of the App (or any part thereof).
3. USER OBLIGATIONS. You agree to abide by all applicable local, state, national, and international laws and regulations (including traffic laws) with respect to your use of the App. By accessing or using the App, you represent that you are at least eighteen (18) years of age (or the legal age of majority, whichever is greater) and will always provide true, accurate, current, and complete information when submitting information or materials to or through the App.
4. PROPRIETARY RIGHTS. The App is owned by American Wood Council and/or its licensor(s). © 2024 American Wood Council All rights reserved. AWC, AMERICAN WOOD COUNCIL, and all other names, logos, and icons identifying AWC and its solutions, products, and services are proprietary trademarks of AWC, and any use of such marks without the express written permission of AWC is prohibited. Other services, products, or company names mentioned or displayed may be the trademarks and/or service marks of their respective owners.
5. PRIVACY POLICY. Please see AWC’s Privacy Policy at https://awc.org/privacy-policy/ for a summary of AWC’s personally identifiable information collection and use practices.
6. ASSUMPTION OF RISK. You acknowledge and agree that use of the App is solely at your own risk, and that you are solely responsible for exercising good judgment, acting in a safe and responsible manner, and obeying all fire safety laws and regulations. You also acknowledge and agree that you will use the App for general information purposes, and that you will not rely on the App for a life-or-death situation.
7. DISCLAIMER. THE APP IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, AND MAY INCLUDE ERRORS, OMISSIONS, OR OTHER INACCURACIES. AWC MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE APP WILL OPERATE UNINTERRUPTED OR IN A MANNER THAT WILL MEET YOUR PARTICULAR REQUIREMENTS AND/OR NEEDS. AWC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8. LIMITATION OF LIABILITY. IN NO EVENT SHALL AWC BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE APP. TOTAL LIABILITY OF AWC FOR BREACH OF THIS TOU IS CESSATION OF USE OF THE APP, AND FOR ANY OTHER REASON RELATED TO YOUR USE OF THE APP WHATSOEVER, THE TOTAL LIABILITY OF AWC SHALL NOT EXCEED $10.
9. GOVERNING LAW. Use of the App constitutes agreement to enter transactions electronically. This TOU has been made in, and will be construed and enforced in accordance with, the laws of the Commonwealth of Virginia, as applied to agreements entered and completely performed in the Commonwealth of Virginia.
10. INJUNCTIVE RELIEF. You acknowledge that any breach, threatened or actual, of this TOU, including, without limitation, with respect to unauthorized use of AWC proprietary assets, will cause irreparable injury to AWC. Such injury would not be quantifiable in monetary damages and AWC would not have an adequate remedy at law. You therefore agree that AWC shall be entitled, in addition to other available remedies, to seek and be awarded an injunction or other appropriate equitable relief from a court of competent jurisdiction restraining any breach, threatened or actual, of your obligations under any provision of this TOU. Accordingly, you hereby waive any requirement that AWC post any bond or other security in the event any injunctive or equitable relief is sought by or awarded to AWC to enforce any provision of this TOU.
11. TERM AND TERMINATION. This TOS will take effect (or re-take effect) at the earliest of the moment you accept this TOS or otherwise have read, understood, and agreed to abide by the terms and conditions for the App, submit an Order Form, and/or begin using the App. This TOS, and your subscription for App, will remain in effect in accordance with the time period for your Subscription as specified in your Order Form. Failure to pay the applicable fee(s) for a Subscription or violation of this TOS will lead to cancellation or termination of your Subscription and this TOS. Cancellation by you shall be conducted through the applicable app store provider and shall be effective (subject to any applicable third-party payment card or processor policies) upon expiration of the then-current, fully-paid time period for your Subscription. Accordingly, you acknowledge and agree that you are liable for charges incurred until such expiration. A Subscription may also be terminated by AWC in the event you breach this TOS. Such termination by AWC shall be immediate and with notice to the address provided on your account with AWC. All applicable provisions of this TOS will survive termination, as identified below, and each re-access, re-subscription, or use of the App will reapply the then-current version of this TOS (then in effect) to you. The provisions concerning AWC’s proprietary rights, disclaimers (of warranty), limitations of liability, waiver and severability, entire agreement, injunctive relief, and governing law will survive the termination of this TOS for any reason.
12. WAIVER AND SEVERABILITY. Failure of AWC to insist on strict performance of any of this TOU will not operate as a waiver of any subsequent default or failure of performance. No waiver by AWC of any right under this TOU will be deemed to be either a waiver of any other right or provision, or a waiver of that same right or provision at any other time. If any part of this TOU is determined to be invalid or unenforceable pursuant to applicable law including, without limitation, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most clearly matches the intent of the original provision, and the remainder of this TOU shall continue in effect.
13. ENTIRE AGREEMENT. You and AWC are independent contractors. No joint venture, partnership, employment, or agency relationship exists between you and AWC as a result of this TOU or your utilization of the App. This TOU represents the entire agreement between you and AWC with respect to your individual use of the App. This TOU may not be assigned, transferred, conveyed, delegated, nor granted by you to another party or person without the prior written consent of AWC. Please note that AWC reserves the right to change this TOU under which the App and its offerings are extended to you, by posting online or on the App a revised TOU, or by emailing notice thereof to you. In addition, AWC may add, modify, or delete any aspect, program, functionality, or feature of the App. Your continued use of the App following any addition, modification, or deletion will be conclusively deemed acceptance of any change to the TOU of this TOU. Accordingly, you are expected to review this TOU on a periodic basis if you continue to use the App.
